The power of a country’s legislative body could either address the concerns of the citizens in a country or ignite conflict in the society, as a result of amending, passing and approving new laws, which the people think have inconsiderate and unfair provisions stipulated therein. The lifting of Boxing Day restrictions in New South Wales is a product of a careless and unmindful leadership. It is because the new law not only deprived people of their right to take a leave or rest from the whole year round tasks but also sparked anger and humiliation over the fact that there is an element of unfair and unjust labor practice and competition.
There seems to be a human and economic rights violation in this case. Occasions like Christmas or New Year come only once a year and if you look at it, this is the only time for families.
Majority of the employers have had a little comment on the issue since the passage of the new law will give them an opportunity to earn extra money during the holidays. It was not clear, however, if they were in favor of the move but being silent on the issue would mean a yes, an obvious way of telling their workers that they should open their doors to customers in order to address their concerns and provide what they need for the holidays. Clearly, the bottom line is money.
Likewise, retailer groups and associations across Sydney and NSW accepted the law positively, since, under the previous ruling, small stores or retailers are prohibited to open for most parts of the holiday. It was a sign of relief because they were given not only the chance to compete with bigger stores during Boxing Day but also the opportunity to serve their loyal customers especially those that are nearby NSW. Their move to open their stores will also reduce congestion of vehicles and people on the streets because loyal customers need not ride very long distances or walk on foot just to purchase grocery items they will need to prepare for the holidays.
In contrast, anger and disgust dominated over workers and employees because for the very first time, they will not be able to spend Christmas with their families. It’s like they’ve been robbed of the opportunity to spend quality time with their families because of the approval and passage of the Retail Trading Amendment Bill of 2015.
It is to be understood that they will be forced to work not only because their store will run out of manpower but also because there is an existing policy of applying a penalty for those who will not be able to report during the holidays. Meaning, neither of them will be allowed to be absent nor they will be allowed to say no to their bosses.
A particular provision in the amendment states that they will not be forced to work; but, with the above-mentioned policies and situations, the picture is still the same.
